Terms of Service

These Terms of Service ("Terms") govern your access to and use of FolioProjects.com, including accounts, property intelligence features, Property Intelligence Snapshots, Purchase Intelligence Snapshots, document uploads, public pages, surveys, QR features, assisted review services, and related content and tools (collectively, the "Platform"). The Platform is operated by Beyond Programs Ltd ("FolioProjects", "we", "us", or "our").

By accessing or using the Platform, creating an account, uploading documents, requesting services, or purchasing any paid feature, you agree to these Terms and our Privacy Policy.

Important professional review boundary: FolioProjects helps organize property evidence, create draft records, identify questions, and suggest possible next steps. FolioProjects does not replace qualified inspectors, contractors, engineers, lawyers, accountants, appraisers, planners, insurance professionals, lenders, realtors, property managers, or other licensed professionals. You are responsible for confirming important decisions with appropriate professionals.

1. Eligibility and account registration

You must be at least 18 years old and capable of entering into a binding agreement to use the Platform. You agree to provide accurate information, keep your account information current, protect your login credentials, and accept responsibility for activity under your account.

2. Platform purpose

FolioProjects is an owner-side property intelligence platform. The Platform may help users collect, organize, analyze, summarize, and act on property evidence such as inspection reports, photos, invoices, insurance letters, leases, permits, quotes, warranties, manuals, notes, and other property records.

The Platform may generate or help create draft findings, property systems, deficiencies, risks, questions, projects, reminders, vendor needs, missing records, capex priorities, rebate opportunities, insurance-readiness questions, and reports.

3. Purchase review and property intelligence outputs

Purchase Intelligence Snapshots, Property Intelligence Snapshots, reports, summaries, recommendations, action plans, and generated records are informational tools only. They are intended to help users organize evidence and ask better questions. They are not guarantees, inspections, appraisals, insurance opinions, legal opinions, tax opinions, engineering opinions, contractor estimates, financing opinions, environmental opinions, or investment advice.

If you are using FolioProjects during a purchase, sale, refinance, insurance review, repair project, public approval process, or other time-sensitive situation, you remain responsible for deadlines, subjects, conditions, notices, due diligence, and professional advice.

4. AI-assisted features

The Platform may use AI, machine learning, document extraction, or similar tools to process documents and generate draft outputs. AI-assisted outputs can be inaccurate, incomplete, outdated, or inappropriate for your specific situation. You must review all outputs before relying on them or taking action.

We may modify prompts, models, processing methods, and generated-output formats over time. We do not guarantee that the same document will always produce the same result.

5. User content and property evidence

You retain ownership of content and documents you upload, submit, or create through the Platform ("User Content"). You grant FolioProjects a non-exclusive, worldwide, royalty-free license to store, copy, process, display, analyze, summarize, and use your User Content as reasonably necessary to operate the Platform, provide requested services, generate outputs, support users, maintain security, and improve the Platform.

You represent and warrant that:

  • You have the right to upload and use the documents, photos, notes, and other information you submit;
  • Your User Content does not violate the rights of others, including privacy, confidentiality, copyright, or contractual rights;
  • You will not upload unlawful, misleading, malicious, or harmful content; and
  • You will not upload tenant, buyer, seller, vendor, or third-party personal information unless you have the right to do so.

6. Public and private content

Some Platform features may create public pages, QR-linked pages, surveys, consultation pages, project pages, portfolio pages, or asset pages. Other features may be private to your account. You are responsible for understanding whether a feature is public or private before submitting content.

Public content may be viewed, copied, indexed, quoted, shared, or archived by others. Do not publish sensitive or confidential information unless you intend it to be public.

7. Payments, pricing, and refunds

Some Platform features or services may require payment, including self-serve Snapshots, assisted reviews, owner plans, portfolio plans, activations, extensions, concierge services, or other paid offerings. Prices may be listed on the Platform or quoted separately. Unless stated otherwise, prices are in Canadian dollars.

You are responsible for applicable taxes, payment information, and authorized charges. Fees are generally non-refundable once work begins, a report is generated, an activation starts, or a paid service is delivered, unless we state otherwise in writing or applicable law requires otherwise.

We may change pricing, features, plans, limits, and included services from time to time.

8. Assisted review and concierge services

Assisted review, concierge, or BP LTD-supported services may be offered for certain users or situations. These services may involve human review, setup, reporting, document organization, or other support. Unless specifically agreed in writing, assisted services are informational and administrative in nature and do not replace licensed professional advice.

9. Third-party services and integrations

The Platform may link to, import from, export to, or work alongside third-party services such as property management platforms, construction platforms, payment processors, email systems, analytics tools, AI providers, storage providers, or other services. We are not responsible for third-party services, their availability, their data accuracy, their terms, or their privacy practices.

We do not guarantee that any integration, import, export, or third-party connection will remain available.

10. Acceptable use

You agree not to:

  • Use the Platform for unlawful, fraudulent, abusive, defamatory, discriminatory, or harmful purposes;
  • Attempt to access accounts, files, systems, or data you are not authorized to access;
  • Interfere with or disrupt the Platform, servers, networks, or security systems;
  • Upload malware, malicious code, or intentionally corrupted files;
  • Misrepresent your identity, property authority, professional status, or relationship to any property or organization;
  • Use the Platform to make automated high-volume requests without permission;
  • Reverse engineer, scrape, copy, or reproduce substantial parts of the Platform except as permitted by law; or
  • Use generated outputs as a substitute for required professional inspection, legal, insurance, financial, engineering, planning, or tax advice.

11. Intellectual property

FolioProjects, the Platform, software, design, workflows, templates, reports, branding, logos, text, and related materials are owned by or licensed to Beyond Programs Ltd, except for User Content. You may not copy, resell, redistribute, or create competing services using our materials except as expressly permitted by us in writing.

12. Beta, pilot, and evolving features

Some features may be experimental, in pilot, or under active development. Features may change, break, be removed, or produce unexpected results. We may limit access, usage, file types, storage, processing, exports, or generated outputs at any time.

13. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted access, and error-free operation.

We do not guarantee property outcomes, purchase outcomes, sale outcomes, financing outcomes, insurance outcomes, rebate eligibility, repair costs, contractor availability, tenant outcomes, investment performance, regulatory approvals, or professional acceptance of any output.

14. Limitation of liability

To the maximum extent permitted by law, FolioProjects and Beyond Programs Ltd will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, property loss, failed transactions, financing issues, insurance issues, repair cost overruns, missed deadlines, or reliance on Platform outputs.

To the maximum extent permitted by law, our total liability for any claim related to the Platform or these Terms will not exceed the amount you paid to us for the specific service giving rise to the claim in the three months before the claim arose, or CAD $100 if no amount was paid.

15. Indemnity

You agree to indemnify and hold harmless Beyond Programs Ltd, FolioProjects, and their directors, officers, employees, contractors, and agents from claims, losses, liabilities, damages, costs, and expenses arising from your use of the Platform, your User Content, your breach of these Terms, your violation of law, or your violation of third-party rights.

16. Suspension and termination

We may suspend or terminate accounts, restrict access, remove content, or refuse service if we believe a user has violated these Terms, created risk for the Platform or others, failed to pay fees, abused the Platform, or used the Platform in a way that may cause harm.

You may request account deletion by contacting support. Some data may be retained as described in the Privacy Policy.

17. Changes to the Platform or Terms

We may change the Platform or these Terms from time to time. The effective date will be updated when the Terms change. Continued use of the Platform after changes means you accept the updated Terms.

18. Governing law and disputes

These Terms are governed by the laws of British Columbia, Canada, and the applicable laws of Canada. The parties will first try to resolve disputes in good faith. Unless otherwise required by law, disputes will be resolved in the courts of British Columbia.
